Although there is ongoing debate regarding the sale of marijuana and whether it should be legalized or not, people often forget that the drug is still illegal in New York State. With that, it is still possible to be arrested on drug charges related to being involved with it. Often drug arrests lead to charges for other allegations. For those who are arrested for drug crimes related to marijuana, it is important to remember that lodging a strong defense can make the difference between a conviction and the accompanying penalties and a plea bargain or an acquittal.
Two people were placed under arrest in odd circumstances after they contacted law enforcement themselves to report that they had been robbed. The call was made at around 11 p.m. When police arrived, the 23-year-old man and 29-year-old woman who reside there said there had been a robbery. As they investigated, the police found that there had been drug activity at the residence with at least one person being involved with the sale of marijuana.
There were advertisements for drug sale on the man's Facebook page with photos, times at which the postings were made, and his inventory. Purchases had been made by an undercover law enforcement officer three times in different places. A warrant was served and more than two pounds of the drug was seized. In addition, there were allegedly bags with small amounts of cocaine. There was cash and a stun gun located in the basement. The couple was arrested on multiple charges related to possession of drugs and a weapon.
Drug laws in New York can be complicated and the penalties can vary depending on the circumstances. While marijuana is treated differently than drugs that are deemed to be more serious, there can still be problematic outcomes for charges related to it. Since cocaine was also found, the charges this couple faces can rise significantly. Having a legal professional assist with crafting a defense is essential when arrested and charged. If facing a criminal case for any drug, the first call that should be made is to an experienced attorney.
